How foreigners must comply with fire safety regulations when operating a restaurant in Vietnam
Content
Vietnam is increasingly attracting foreign investors in the food and beverage sector, especially in major cities such as Hanoi, Da Nang, and Ho Chi Minh City. However, in addition to investment procedures and business licensing, complying with fire prevention and fighting (PCCC) regulations is mandatory for a restaurant to operate legally. Failure to comply may result in administrative penalties, suspension of operations, or even revocation of business licenses.
The article below helps foreign investors understand the fire safety requirements when running a restaurant in Vietnam.
1. Are restaurants required to register for fire safety compliance?
Under Vietnamese law, restaurants are classified as establishments with a high risk of fire and explosion due to the use of gas, heat-generating equipment, electricity, and large gatherings of people. Therefore, most restaurants must comply with fire safety requirements and, in many cases, must obtain:
- Fire Safety Certificate (for establishments listed as high-risk under regulations)
- Fire Safety Design Approval (for newly constructed or significantly renovated buildings)
Foreign investors should check the type and scale of their business to determine specific requirements.

2. Basic fire safety requirements for restaurants
A restaurant must ensure at minimum:
- Clear escape routes and unobstructed emergency exits
- Fire extinguishers that meet technical standards and are placed correctly
- Automatic fire alarm or fire suppression systems (depending on scale)
- Fire safety regulations, signage, and response plans
- Electrical installation meeting safety standards and maintained regularly
For open-kitchen models or restaurants using high-capacity gas systems, requirements are typically stricter than those using electric or steam-based industrial kitchens.
3. Required fire safety documents when opening a restaurant
Depending on the type of building and relevant authorities, investors must prepare:
- Fire safety design documentation for approval
- Fire safety acceptance report
- On-site fire response plan
- List of trained fire safety personnel
- Fire safety training certificates for employees and managers
Foreign investors should work with a professional consultant from the beginning to avoid costly redesigns after construction.
4. Responsibilities of the investor and restaurant owner
Whether the investor is foreign or Vietnamese, fire safety obligations fall on the business owner and the person directly managing the establishment.
The restaurant owner must:
- Conduct regular fire safety drills and training
- Inspect gas systems, electrical systems, fire extinguishers, and alarm systems
- Maintain documentation and provide it during inspections
If the restaurant is located in a commercial building, the building may already have fire safety systems installed, but this does not exempt the restaurant from compliance obligations.

5. Common fire safety violations in foreign-invested restaurants
- Failure to register or obtain design approval prior to construction
- Expired or non-standard fire extinguishers
- No fire safety training for foreign staff
- Substandard gas pipelines and lack of periodic inspection
- Flammable interior materials installed near heat sources
These violations often result in high penalties or suspension of operations.
6. Recommendations for foreign investors
To comply with fire safety regulations when operating a restaurant in Vietnam, investors should:
- Hire a fire safety design consultant from the layout phase
- Use electric kitchen systems instead of gas when possible
- Establish bilingual (Vietnamese–English) internal safety procedures
- Train all staff, including foreign employees
Proactively complying with fire safety requirements is not only a legal obligation but also protects assets, customer safety, and business reputation.
Compliance with fire prevention laws is mandatory for foreign-invested restaurants in Vietnam to operate and remain sustainable. With thorough preparation and strict oversight from design to operation, businesses can reduce risks, save costs, and ensure long-term safety.
