Recruiting foreign employees in Vietnam: Work permit regulations and practical experience

In the context of international economic integration, an increasing number of businesses in Vietnam are hiring foreign employees to bring high expertise, international experience, and expand their business networks. However, hiring foreigners is not simply about signing an employment contract; it must also comply with strict legal regulations, especially regarding work permits and administrative procedures.
This article provides guidance on legal regulations and practical experience when recruiting foreign employees in Vietnam.
1. Who needs a work permit in Vietnam?
According to the Labor Law and guiding decrees, foreigners working in Vietnam are required to have a work permit, except for certain exempt cases. Those who need a work permit include:
- Directors, deputy directors, department heads, or project managers.
- Experts, engineers, and senior specialists under an employment contract with a Vietnamese company.
- Foreigners working more than 3 months (depending on the industry and type of enterprise).
Exemptions from a work permit:
- Foreigners working less than 3 months in a year.
- Participants in foreign-invested projects that are exempt under regulations.
- Experts specially permitted by the relevant government authority.

2. Conditions for obtaining a work permit
To be issued a work permit, foreigners must meet the following conditions:
Professional qualifications:
- Hold a university degree or relevant professional certificate for the position.
- Have at least 3 years of related work experience for management or expert positions.
- Health: Possess a health certificate issued by a competent medical facility, free from serious infectious diseases.
- Employment contract: Sign a labor contract with a Vietnamese company for a minimum of one year.
- Company profile: The recruiting company must be legally operating and have the appropriate business lines for the position.
3. Work permit application documents
The application usually includes:
- Work permit application form as prescribed by the Ministry of Labor, Invalids, and Social Affairs.
- Valid passport of the foreign employee.
- Signed labor contract.
- Health certificate.
- Diplomas, professional certificates, and work experience records.
- Company introduction letter confirming the position, salary, and job duties.
After submission, the competent authority will review and issue the work permit within approximately 10 - 15 working days if the application is complete and valid.
4. Practical experience in recruiting foreign employees
- Prepare complete and accurate documents: Many applications are returned due to mismatched information or missing proof of qualifications or experience.
- Determine the appropriate type of work permit:
- Short-term experts may apply for an exemption or a short-term visa with a work confirmation.
- Long-term managers and experts require a Work Permit with proper renewal according to law.
- Comply with insurance and tax regulations: Foreign employees must contribute to social insurance (if applicable) and declare and pay personal income tax properly.
- Use professional consulting services: Legal firms or HR consulting services save time and avoid legal errors.
5. Important notes
- Work permits have a limited validity and must be renewed before expiration to avoid legal violations.
- Foreign employees must always comply with labor laws and related regulations while working in Vietnam.
- Illegal recruitment or working without a permit can result in heavy administrative fines or even deportation.
Recruiting foreign employees in Vietnam brings many benefits but comes with strict legal procedures. Preparing complete documentation, understanding work permit regulations, and complying with the law helps businesses leverage the expertise of international staff while minimizing legal risks and optimizing operations.
